Description:

Duties: Plans, organizes and directs the substantive, administrative and operational activities of the Sourcing Contracts (SC) group within ES&SM (Enterprise Sourcing and Supplier Management). Manages business risk, contributes to the efficient production of high quality supplier RFPs (Requests for Proposal) and RFIs (Requests for Information), drafts and negotiates supplier contracts and assumes responsibility for all contract-related activities during the life of supplier relationships. Assists in the development of divisional and departmental objectives, processes, procedures and policies to support corporate goals and strategic plans. Additionally, ensures adherence to and compliance with related local, state and federal regulations/statutes and policies and procedures. Directs overall planning, staffing and management of the services provided by the SC group. Provides Subject Matter Expertise for the evaluationand identification, of service delivery capabilities and performance and mitigation of risk in the business, financial and contractual areas of SBU/FCE requirements, supplier proposals and contract terms and conditions. Participates in the development of the long-term direction for the procurement organization, keeping in mind the impact of current actions on future goals and objectives. Delegateds commitment authority on behalf of organization for all procurement up to $2,500,000.00. Working with the Executive Director, formulate and implement strategies that increase customer service levels and reduce cycle time and cost in the area of supplier management. Directs the activities of, provide leadership to, mentors and promote professional growth and development of the staff; monitor, evaluate and train staff in work performance, interview and hire new staff as required. Establishes short and long-range goals and objectives; delegate and/or coordinate the appropriate planning and implementation of projects/activities to achieve goals and objectives. Assists the Department Executive Director in the establishment of policies and procedures; ensure compliance with all applicable corporate policies and procedures, including those controlling confidentiality of intellectual property and proprietary information, records retention, physical security, financial controls, staff management and quality control. Develops and/or recommends new policies and guidelines that facilitate business growth through the development of supply chain strategy and policy. Coordinates the competitive bid process; establish guidelines and measurements to meet departmental cycle time goals; contribute to achieving departmental cost savings/avoidance goals. Exercises delegated commitment authority on behalf of organization as authorized; assumes responsibility for review and approval (as required/appropriate)of bid replies, contracts, purchase orders and related documents pursuant to delegated levels of approval. Supports and guides the SC group to increase the use of MWDVBE suppliers in transactions and cooperate with MWDVBE group staff. Chairs or serves as leader for ad hoc cross-functional teams to identify department or division management needs and appropriate alternatives; plans strategy, develops specifications, implement new processes and procedures and develops cost estimates. Acts as owner of the Ariba document management system and direct system use by staff. Interacts with internal clients, staff and suppliers at all levels to promote organization and Department policies and procedures; educate staff on the Departments commitment to provide value added, strategically focused, cost effective services. Ensures that staff members take responsibility for delivery of superior internal client service and provide prompt feedback to inquiries and requirements; display a positive, internal client-oriented work ethic to co-workers, suppliers and internal clients, promoting accuracy, efficiency, objectivity, courtesy and fairness. Provides subject matter Expertise to the department and across on the procurement , supplier contracting and supplier relationship management processes. Develops appropriate metrics and reporting for the organization and suppliers. Processes outputs and deliverables. Documents including negotiated financial, legal and business terms favorable to organization. Processes improvements and innovative solutions to policy and problem issues. Selection, development and management of professional staff. Establishment of metrics and reporting protocol. Will be actively involved in securing appropriate sourcing agreements and supplier performance while mitigating business risk to the organization as it applies to procurement. Works closely with representatives of Finance and the General Counsel (upstream interdependence) and FCEs and SBUs who are dependent on the output of the procurement process. Many responsibilities focus on the continual improvement of processes and procedures and require innovative thought along with a high level of Subject Matter Expertise. Stakeholders include all SBUs, FCEs, senior management, peers and departmental staff and external suppliers. Qualification and Experience Requirements: A J.D. and/or an MBA degree. 15+ years of progressively responsible business, legal, functional management and staff supervisory experience within a buyer or seller contract management organization and/or law firm. Working knowledge of generally accepted procurement principles and the ability to establish policies and procedures. Sound knowledge of contract negotiation/development/execution and client relations. Prior experience in identifying business and contract risks, customer contract negotiations working with strategies aimed at managing/mitigating risk. Exposure to business law aspects of customer and supplier contracts.
